User Agreement

This User Agreement (“Agreement”) applies to all users who create, manage, or publish QR-based listings or content through the QrMagnet platform (“Services”).

By creating or publishing any content, you agree to the following:

1. User Responsibility

You are solely responsible for all content you create, publish, or distribute through the Services, including but not limited to property information, images, descriptions, pricing, and contact details.

QrMagnet does not create, edit, verify, or control any listing or content.

2. Accuracy of Information

You represent and warrant that all information you provide is accurate, current, and not misleading.

You agree not to publish false, incomplete, or deceptive information.

3. Legal Compliance

You agree to comply with all applicable laws and regulations, including but not limited to:

• real estate laws and regulations applicable in your jurisdiction;
• advertising and marketing laws;
• privacy and data protection laws;
• communication laws, including TCPA (Telephone Consumer Protection Act);
• anti-discrimination laws, including the Fair Housing Act.

4. Fair Housing Compliance

You agree that you will not create, publish, or distribute any content that is discriminatory or violates any fair housing or anti-discrimination laws.

This includes, but is not limited to, discrimination based on race, color, religion, sex, disability, familial status, national origin, or any other protected class.

5. Lead Handling and Communication

You are solely responsible for how you use, store, and communicate with any leads or contact information obtained through the Services.

You agree that:

• you will only contact individuals who have voluntarily submitted their information;
• you will comply with all applicable communication and marketing laws;
• you will not engage in spam, harassment, or unauthorized marketing.

QrMagnet is not responsible for any communication between you and any third party.

6. Content Ownership and Rights

You represent and warrant that you own or have the necessary rights, licenses, and permissions to use and publish all content.

You agree not to upload or use any content that infringes on intellectual property rights or violates any third-party rights.

7. Prohibited Conduct

You agree not to:

• publish misleading or fraudulent listings;
• impersonate any person or entity;
• use the platform for unlawful purposes;
• attempt to manipulate, abuse, or exploit the system;
• use the platform to create or distribute harmful or illegal content.

8. QR Code Usage

You are responsible for the placement, use, and maintenance of any QR codes associated with your listings.

QrMagnet is not responsible for:

• misuse or improper placement of QR codes;
• physical damage to printed QR materials;
• user errors in scanning or accessing QR content.

9. Platform Role

You acknowledge that QrMagnet is a technology platform only and:

• is not a real estate broker, agent, or intermediary;
• does not participate in any transaction;
• does not verify listing content;
• does not guarantee any outcomes.

10. Indemnification

You agree to indemnify and hold harmless QrMagnet from any claims, damages, or liabilities arising from:

• your content;
• your actions or communications;
• your violation of any laws or regulations.

11. Enforcement

QrMagnet reserves the right to remove content, suspend accounts, or terminate access at any time if this Agreement is violated.

12. Relationship to Terms of Use

This Agreement is part of and supplements the Terms of Use.

In the event of any conflict, this Agreement will control with respect to user-generated content and listings.

13. Changes to This Agreement

QrMagnet reserves the right to update or modify this Agreement at any time. Continued use of the Services after any changes become effective constitutes your acceptance of the updated Agreement.
